We make every effort to ensure that this website is free from viruses or defects. However, due to the nature of the Internet, we cannot guarantee that your use of this website will not affect your computer. We recommend that you purchase the correct firewall and anti virus software to enable use of this and other websites and to screen out anything that may cause damage. We shall not be liable in the very unlikely event that while using this website your computer equipment is damaged.

 
Accuracy of Content

We pay particular care and attention in the preparation of the content of this website. We ensure that prices and dimensions are correct at the time of publishing and that all products have been fairly and accurately described. All prices are displayed inclusive of V.A.T. at the prevailing rate.

We make every effort to display the colour of the furniture and products as accurately as possible. However as colour reproduction depends on your computer’s monitor and is subject to a number of factors beyond our control, we cannot guarantee that your monitor’s display of the colour will be an exact match to the actual product itself.

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights of all materials and / or content made available as part of your use of this website shall remain at all times with Woodstoneuk or our licensors. You are permitted to use this material only as expressly authorised by us.

You acknowledge and agree that the material and content contained within this website are made available for your personal, non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

 
 
Other Provisions

Our products are chosen on the basis that they are suitable for and will be used for domestic use. If you are planning to use them for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.

Woodstoneuk shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond our reasonable control. (See Delivery Dates section below.)

It is your responsibility to inform us of any updates, changes or amendments to your account information.

 
Principal Terms & Conditions of Sale

Payment

A minimum deposit of 50% of the gross value of items not in stock (i.e. made to order / custom-made) is required at the time of order.

Full payment is required for all items in stock at the time of order.

Remaining balances require to be paid in full a minimum of 120 hours / 5 (working) days prior to delivery and delivery cannot occur until all remaining balances are received.

All goods remain the property of Woodstoneuk until such time as payment is made in full.

Delivery arrangements made are subject to receipt of any remaining balance payable being made in accordance with the above. Delivery arrangements will become null and void in the event of balance payments not being received by Woodstoneuk in sufficient time. Woodstoneuk will not be liable for any consequential claim for loss in respect of this.  

Title

All goods supplied to the customer by us remain the property of Woodstoneuk until such time as payment in full has been received and cleared through the banking system. In the event of the customer being in default of payment, Woodstoneuk may remove and resell the goods. In placing an order with Woodstoneuk , the customer grants Woodstoneuk irrevocable permission to enter their premises at any time to examine and /or recover the goods.

Risk

Risk in Goods (including damage & loss) shall pass to you at the time when you collect the Goods or when we deliver the Goods or, if you wrongfully fail to take delivery of the Goods, at the time when we have tendered delivery of the Goods.

Delivery

The customer is responsible for ensuring the dimensions of their purchases are suitable for (and for access to) their home, office or other intended environment or use. (Please contact us for assistance if in any doubt. Please note that many of the items we supply are or can be supplied disassembled to facilitate installation.)

It is the customer’s responsibility to ensure that it is practical to complete the delivery and to bear any cost for the delivery i.e. removal of doors or windows to accommodate furniture etc.

When furniture is delivered it will not normally come supplied with soft pads on the feet or legs as most furniture is still used on carpeted flooring. If the furniture is to be placed on hard flooring (wood, laminate or ceramic) you, the customer, must make adequate arrangements to protect the floor during and after delivery. We cannot accept responsibility for any damage to such flooring sustained during delivery or afterwards. (Furniture should always be lifted to effect its relocation. Sliding of furniture should be avoided as this places undue strain on joints, components and materials.)

Delivery of goods will be deemed to have taken place when they are taken from the delivery vehicle at the customer’s delivery address.

Whilst Woodstoneuk and its contracted parties always exercise great care and consideration whilst on the customer’s property, Woodstoneuk shall not, under any circumstances, accept liability for any occurrence that may take place thereon.

The customer (or the customer’s appointed agent) must inspect all goods upon delivery and advise of any shortage, damage or defect at this time. Should this be impractical because of the packaging, etc., written notification must be received by Woodstoneuk within three days of delivery. Claims for damages made outwith this period shall not be the responsibility of Woodstoneuk and may be deemed to have been caused after the time of delivery.

If a third party carrier is uplifting goods fromWoodstoneuk or Woodstoneuk ’s appointed contractor on behalf of a customer, the carrier must inspect the goods at the time of uplift to ensure all items are free from damage and defect. Claims for damage subsequent to uplift which are not intimated to Woodstoneuk at the time of uplift will not be the responsibility of Vintage & Reclaimed. It is the customers’ responsibility to bring this requirement for inspection to their carrier’s notice prior to collection.
 
Storage

 If the customer is unable to take delivery of the goods when they become available, storage can be arranged free of charge for a maximum period of 4 weeks providing payment of any remaining balance has been made within 7 days from the time of notification of availability.

Storage for longer periods can only be made at Vintage & Reclaimed’s discretion and will be subject to charge.

Storage Insurance

Woodstoneuk  will insure the goods whilst in storage however claims will be restricted to an amount not exceeding the value of the goods as determined by the SOC. In the event of a claim, Woodstoneuk reserve the right to offer to replace or repair the goods or to provide a refund of payment for the goods. This will be at the discretion ofWoodstoneuk . Storage charges for the period, if applicable, are chargeable in full and will not be refunded.

Delivery Dates

All dates quoted at the time of order are made in good faith and whilst every effort will be made to honour them, these are estimates only. Time is not the essence of the contract and consequently Woodstoneuk shall not accept any liability nor damage or compensation claims for consequential loss arising from overdue deliveries.

 
Returns & Exchanges

Woodstoneuk  14 Day Returns Policy – Your Right to Return or Exchange the Goods and Receive a Refund.

You may return Goods free of charge* by notifying us of your intent to do so within 14 days of delivery by us (or of collection of the Goods from us, if applicable). After 14 days, if we have not received such notification, you will be deemed to have accepted the Goods. After acceptance, you shall not be entitled to return Goods.

The Goods must be returned in the same condition as delivered to (or collected by) you, and must not be used. A full refund will be given for the returned items exclusive of the original delivery charges paid. (No charge will be made for the uplift of the returned items*).

You, as the buyer, have a duty of care for the product whilst it is in your possession. You must make the Goods available for collection within 14 days of notifying us of your wish to return the Goods. You are the owner of the Goods once delivered to you and you are consequently liable for any loss or damage. Failure to take reasonable care may result in a claim against you or our refusal to accept the Return or make payment of a full refund.

Refund payments will normally be made within 10 working days of any such Return being collected from you by us and only after such time as we have inspected the condition of the Returned item(s).

To minimise the risk of any such claim we ask that you cover the Goods to protect them from any accidental damage, retain the original packing where applicable and use this when returning the Goods.

For hygiene reasons mattresses, once unwrapped, cannot be returned, unless faulty.

You may exchange Goods free of charge* by notifying Woodstoneuk of your intent within 14 days of delivery by Vintage & Reclaimed or our appointed carrier (or 14 days of collection of the Goods from Woodstoneuk , if applicable), subject to the conditions of the above clause.

The Goods to be exchanged must be specified at the time of notification to Woodstoneuk , otherwise it will be classified as a return (see clause above) followed by a new Order.

We endeavour to collect the Returning Goods and deliver the Exchange Goods at the same time (however please be aware that this may require you to store the returning Goods safely, unused and undamaged for a reasonable period of time until such time as the exchange goods are ready to be delivered to you).

In the event that you collected the Returning Goods and Exchange Goods are not being supplied, we would request that you deliver the Returning Goods back to us. In the event that you request us to collect theses Returning Goods, a delivery charge will be made other than in the event of a fault.

*Please Note that no refunds or exchanges can be given on Custom Made Orders unless there is a manufacturing defect or unless the Goods are not as specified on the SOC.

If you wish to exchange an item we will deliver the exchange free or charge however your original delivery charge will not be refunded.

In the event that you collected the original Goods but require collection / delivery for the exchange then a delivery charge will apply. Delivery / collection charges will also apply for subsequent returns and exchanges.

If you wish to add Goods to an existing Order then Woodstoneuk will use reasonable endeavours to fulfil your request and extra delivery charges will not apply where:-

a. the supply of such additional Goods can be included within the delivery of the original Order to which you’re adding, whether arranged or not, without causing any delay or complications.

(In this case a subsequent return or exchange of such additional Goods shall be treated as a return or exchange of Goods within the original Order.)

b. such additional Goods can be included within a return collection or exchange visit for the original Order, whether arranged or not, without causing any delay or complications.

(In this case any subsequent return or exchange of such additional Goods shall incur a collection charge (i.e. equal to a new order delivery charge).

If you wish to add Goods to an existing Order and, despite reasonable endeavours to fulfil your request, if we are unable to deliver these additional Goods with the planned / scheduled delivery of the original order, then the additional Goods will require to be treated as a new Order and a delivery charge will apply as normal.

 
*UK Mainland only. Outside of UK Mainland delivery charges and collection charges apply for all Orders, returns and exchanges and these are not refundable. Additional delivery charges will be made for additional Goods added to an existing delivery or collection where there are extra costs involved for Vintage and Reclaimed.

Cancellation by You Prior to Delivery

The term “Cancellation” refers to a cancellation of an Order or part of an Order by you, prior to delivery to you / collection by you.

In the event that you wish to cancel an Order or part of an Order, you should notify us as soon as possible.

In the case of a Custom Made Order you will not have the right to cancel the Order once it has been placed. If you do wish to cancel all or part of a Custom Made Order at any time after the Order has been placed then you will remain liable to pay for the Goods in full.

 
Cancellation by You, After Delivery

A cancellation after delivery is termed by us as a Return. Please refer to the section above on Returns & Exchanges.

 
Cancellation byWoodstoneuk / (Us)

If we are unable to complete delivery due to any reason including but not restricted to the discontinuation of Goods or an inability to source the materials to make your Order (in full or in part) within a reasonable time, we reserve the right to cancel the Order in full or in part.

We will notify you via the contact details provided by you at the time of Order or as held by us at this time. Any payments made for such cancelled Goods will be refunded. Woodstoneuk  will not be obliged to offer any compensation for disappointment suffered.

 
Refunds

All refunds will be made as soon as reasonably possible after agreement by Woodstoneuk to make the refund. Under normal circumstances, this will be within 10 working days of the date agreed or, if applicable within 10 working days of the physical collection or return of associated goods. Refunds of payment or deposits for Goods will be given at the value paid (we will require your bank details so that we can transfer funds directly to your bank account) minus any charges levied in accordance with these Terms.

Guarantees

Your Goods are guaranteed such that should any structural or manufacturing fault occur under guarantee then we will either repair or replace (at our own discretion) the Goods free of charge. The above statement is subject to the following:-

This guarantee applies to UK Mainland only.

We shall have no liability whatsoever in respect of this guarantee if any sum owing by you to us has not been paid.

The guarantee period is dependent upon the furniture type, as set out here:

a. 10 Year Guarantee Period: All Reclaimed furniture items made by us in the UK (e.g. Dining tables, benches, beds, wardrobes, chests, cabinets, coffee tables, wood-framed mirrors, bedsides, bookcases. (excluding reclaimed chairs and excluding mattresses – see below.)

b. 5 Year Guarantee Period: All Reclaimed chairs made by is in the UK.

Guarantees are valid from the date of delivery / collection.

Any Goods not listed here have a 1 year guarantee. Mattresses have a 1 year guarantee. Fabric (whether incorporated into an item or not) has a 1 year guarantee.

Guarantee Exclusions:

Goods are guaranteed for normal domestic use, and not for commercial use.

All Goods require some routine maintenance – see Caring for your Wood

Proper care and use of your furniture are essential to preserving your rights under this guarantee. We will not replace nor repair your furniture if improper maintenance or improper use, inappropriate placement or extreme environmental conditions cause damage.

This guarantee does not apply if your product is damaged by the use of detergents, abrasives or other harsh cleaning agents.

Wood has certain natural and inherent characteristics. It will continue to respond to its immediate environment. Shrinking, swelling, hairline cracks, opening and closing of the wood grain and minor movement due to changes in temperature and humidity levels are all natural and to be expected. Changing weather, temperature and moisture conditions may affect all of these responses. This will not affect the durability, serviceability, lifespan or beauty of your furniture and such changes and movements within wood are completely normal and natural. These natural movements are not considered structural defects and are therefore not covered under this guarantee.

Genuine leather has certain natural and inherent characteristics. Individual hides or skins will display small markings such as healed scratches and scars, insect bites, growth wrinkles and skin folds. Variations in surface colour and grain texture will also be evident. The presence of such characteristics differs from hide to hide and with different leather types. We consider that such markings contribute to the beauty of genuine leather and distinguish it from overly corrected and inferior leathers or from artificial, man-made materials.

Such markings and characteristics are excluded from your guarantee, however unused Goods may be returned within 14 days under our returns policy.

Fair wear and tear in normal domestic use is excluded.

Damage resulting from negligence, abuse or accidents (including stains, burns, cuts, scratches, tears, scuffs, watermarks, indentations or pet damage) is excluded.

Damage caused by direct sunlight is excluded. The ultraviolet rays of the sun can damage, dry or fade fabrics, leathers and wood and we recommend that you keep your furniture out of direct sunlight unless you are happy to live with the fading or drying effects.

Damage caused by proximity to heat source or extremes of temperature. As mentioned above, natural materials will continue to respond to their immediate environment. Furniture will “settle” into its new home over a period of time and changes may be notable particularly in the first few ways of a new item arriving in your home. Take care not to subject your furniture to extremes of temperature or humidity levels which may be caused by proximity to an aga, a wood-burning stove, radiator etc. Damage caused as a result is excluded from guarantee.

The Goods are designed and built to suit their intended environment and thus are only guaranteed for such use.

Guarantees apply to the original purchaser and delivery address as detailed on the SOC paperwork. It is not transferable or assignable.

Please Note: Keep your paperwork safe. When you purchase your Goods please keep your SOC and receipt of payment. This will contain your Order Number, which must be quoted in order for your guarantee to be valid. If you wish to make a claim under the guarantee please contact us quoting your SOC reference.

If you are unable to provide proof of purchase, we may be unable to respond to your claim.

Matching Finishes

Orders may consist of a number of items supplied by different manufacturers or made up from different batches of timber from different sources and colour matching will not be achieved in such instances.

Where orders are made up of products from a single manufacturer or single source of timber, we will endeavour to supply items with as close a colour match as possible.

However where products are made from natural materials, Vintage & Reclaimed will not guarantee a match and accept no responsibility for doing so. We view natural colour and shade variation as intrinsic and appealing.

When merchandise has been ordered at different times or dates we are unable to guarantee a precise colour match.

 
Reporting a Perceived Fault or Problem

Where issues are reported pertaining to items we have supplied, we will normally request in the first instance that a digital photograph is emailed to us for the purpose of more readily quantifying the precise nature of the issue. Thereafter we will contact you to discuss our intended actions and we may arrange a site visit. All such visits will usually be made between the hours of 9.00 a.m. and 5.30 p.m., Monday to Friday. In the event that any issue cannot be resolved in situ and / or at the time of the visit, Woodstoneuk reserves the right to pursue any or all of the following courses of action or others as may be deemed appropriate under the circumstances.

Uplift and remove the affected item(s) to effect repair or replacement before arranging to re-deliver the item at a later date,

Appoint a qualified practitioner to effect repair in-situ on Woodstoneuk ’s behalf.

Uplift and remove the affected item(s) and make payment of a refund in full and final settlement.

Leave the affected item(s) in situ until such time as a suitable replacement item can be delivered.

Refuse to offer a refund and / or replacement in instances where further material damage has occurred after delivery of the item(s).

Instruct an independent arbitrator to carry out an inspection and provide a written report on the affected item(s)

Woodstoneuk  is not responsible for delays caused by manufacturers or carriers with regard to the provision of replacement items and will not accept liability for any consequential loss or claims in this regard.

 
Variation of Terms & Conditions

i. Our staff do not have the authority to vary the Terms and Conditions of Sale. They are subject to change without prior notice.

ii. All sums quoted are inclusive of VAT at the prevailing rate.
